Juvenile Justice Act needs amendment

, a 17 year old teenager , murdered three members of his family but rather than
punishing him under criminal laws, he was sent to prison in rehabilitation centre
. However, on the other hand , if the same crime was committed by a person of
18 + he must have registered under some section of IPC . As a result of which
he will be awarded with capital punishment .
Any juvenile can commit heinous crimes like
rape , murder can get away with it , this is what , such kinds of verdicts
reflects . Even the verdict of Delhi gang rape conveyed the same message especially
to all those potential juvenile rapists . The legislative body of India should understand
the fact now that today, the mental maturity of a 16+ child is far more than it
was decade ago . Hence, there is a need to lower the age of juvenile from 18 to
16 . At the age of 16 , one can easily judge between right and wrong . Infact,
there are many countries like Scotland, which treat a 16 year old person as an
adult and also gave them right to vote .
It
has also been observed that during age of 16 – 18 , juvenile convicts more
crimes . According to National Crime Record Bureau data for 2011, 64% of all
juveniles criminal fall under this age group and hence , leading to a number of
21,657 crimes .However, according to “Crime in India 2011” suggest that the number
of rapes committed by juveniles have reached a count of 1149 in 2011 from 485
in 2002.
India
is not only a single country which has recorded such a tremendous increase in
number of crimes committed by juvenile even countries like U.S. and U.S.A. have
also observed it but unlike India they have amended the Justice Juvenile Act .
Persons above 16 must be treated as adults and should be prosecuted under
criminal laws and even in rarest of the rare cases like 16 Dec gang rapes they
must be eligible for “Capital punishment” rather than just sending them to any rehabilitation
centre for 3 years .
Today,
we are living in the technological era of 3D and 3G, one’s life is incomplete
without technology, then why we are still attached to our outdated laws, they
should be changed. They too need fresh air of amendments so that they can bear
the beautiful flowers of unbiased and pure justice .
